Pillar 4 — HARM
This is where everything comes together.
Harm is what happens when Pillars 1, 2, and 3 collapse. Every day is a fight to prevent the harm and abuse as technically defined by law from from collapsing down on me. It feels like Greek mythology guy who roles the rock up the hill every day to wake up with it back at the base of his mountain.
Harm is the Combination of Lack Of Notice (Pillar 1) + Lack of Access (Pillar 2) = Failure to Accomodate (Pillar 3)
When Pillars 1, 2, and 3 collapse, the roof of Legal Protections falls down. I refer to it as a 1, 2, 3, Knock-out Punch. This is the systemic approach used by almost every agency and professional responsible for my care. There are incredible, caring people on my side as well, but at some point I will tally them up, as y estimate is 90% of the people who are suppose to be helping me are not.
The 1, 2, 3, Knock Out Punch not only comes from professsionals but family and friends. Read the reports: based on facts with evidence..
As a vulnerable adult, this harm is magnified because my safety and well being depend on systems working correctly
For vulnerable adults, like myself, this harm is magnified because our safety depends on systems working correctly.
Agencies often deny harm because they look only for physical injury. But in reality, administrative systems rarely physically punch one out , sexually rape you, or call you ugly names. They are far too sophisticated for this. Harm is usually:
Procedural harm (unfair steps, broken rules)
Cse manager starting September 2025. Immediate email gets no response form the agency until September 18th. The name of the case manager and she says she will call next week. She doesn’t and in the following week (almost October now) my community health workers says, “well she didn’t keep her word on that one. What a way to start out.” It was a clear indicator of far worse things to come.
Cognitive Overload
For Example: The almost two hour phone call with my case manager that I had to end, resulting in an email that I refused to answer her questions. The answers to these questions are clearly stated in my assessment report already, but she had to go over them again with no draft. Who are you? Tell me about yourself? What’s important to you? For me to know about you? How did you life begin? What are your mobility requirements (after just forwarding her an MD letter stating I use a wheelchair. I’m confused: did she read it? Can she remember and recall information? It is very difficult to deal with someone who can’t read, or maybe reads but doesn’t comprehend, or maybe just lacks memory and has memory disabilities like I do?)
Confusion and Disorientation caused by System Errors
For example, appeal misstatement of the docket number by the judge. A hidden document in the evidence pack from Henn Co Appeals Lead Ms. Keely Broderick, where the 163 pages are misnumbered, and document 8 is a doicument I have never seen and falsified information she wrote to support her denial. How devious!
Worsening of disability symptoms
Emotional trauma or re‑traumatization
Disruption of services and supports
My budget of over $40K for my CADI waiver is spent at the 4% level and no one has asked a single question or offered to help. The PTSD from the assault has made it difficult for me to let anyone in my home without a proper surveillance system in place. This can be authroized given the violant nature of the assault, but the case managers refuse to even address the issue. 4% in the Spending Summary also requires a case manager to have a discussion with the Consumer, which has never happened, even now in December when it is still at less than 4%. Perhaps they are poor and need the money back so they do whatever they can passive agressively or just pure neglect to make sure I can’t spend hardly anything.
Housing instability or eviction risk
Risk of medical decline
Loss of legal rights or appeal opportunities
Loss or interruption of benefits needed to live
