Overview of Case Managers Failure to Perform Statutory Required Services

This report details county failures to follow accommodation requirements, report abuse, follow up on referrals, and coordinate adult protection services (Minn. Stat. § 626.557).

Client uses a wheelchair but case management refuses to provide resources and funds to widen doorways so a wheelchair can be used in his home. He cannot use his shower, enter the bathroom, the bedroom and other rooms given the doorways are standard width. Three years of attempting to gain funding have been ignored.

Attempts to gain even limited funds under the digression of the case manager have been repeatedly denied with the explanation they can’t do it, yet three years ago the case manager did approved the $5000 annual funds under her authority. Clearly it can be done. The case managers are denying the requests in spite of providing the required documentation, and stating they cannot when it has already been done by a previous case manager. Attempts at reconsideration are thwarted in multiple ways. Hennepin County Oversight refuses to address case management failures, and continues to pay them for the failure to act legally. The evidence shows there is not Hennepin Count Oversight, and requests for confirmation have been repeatedly ignored, in spite of a stated Person Centered approach. Not even a response to multiple requests.

Several requests asking if the unspent budget funds that case managers failure to help use and are returned to the County result in bonuses or advantages to the case management agencies are also repeated unanswered.
